These Terms of Service (“Terms”) govern your access to and use of Dinemetry AI (the “Service”), operated by Dinemetry LLC (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.
Using the Service
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
Your data and content
You retain ownership of the business data you upload or connect to Dinemetry. You grant us a license to use that data solely to provide and improve the Service for you — including generating recommendations, storing invoices, and syncing connected tools like Square. We do not use your business data to train models for other customers.
Intellectual property
The Service — including its software, design, underlying technology, and the Dinemetry AI name, logo, and branding — is owned by Dinemetry LLC and protected by copyright, trademark, and other intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for your own business purposes. Nothing in these Terms transfers any ownership of the Service, its code, or the Dinemetry AI name and branding to you.
If you believe content on the Service infringes your copyright, contact us with a description of the material and its location on the Service, and we will investigate and respond in accordance with applicable law.
Third-party integrations
If you connect a third-party service (such as Square), you authorize Dinemetry to access data from that service on your behalf, subject to that service’s own terms. You can disconnect a third-party integration at any time.
Payment and billing
Paid plans are billed through Stripe on a recurring basis as described at checkout. Fees are non-refundable except where required by law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or other users’ accounts
- Interfere with or disrupt the Service, including through automated bot traffic
- Reverse engineer or resell the Service without our written permission
Disclaimers
The Service, including any AI-generated recommendations, is provided “as is” without warranties of any kind. Recommendations are informational and do not guarantee any specific business outcome. You are responsible for your own business decisions.
Limitation of liability
To the maximum extent permitted by law, Dinemetry is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.
Termination
We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service and close your account at any time.
Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
